Anyone who believes that infidelity, i.e. an infidelity, is no longer considered marital misconduct is very much mistaken. But adultery is not the only reason for divorce - there are many more. Which ones and what do you have to look out for and when does marital misconduct not apply? Divorce expert Maria Christina Kolar-Syrmas knows all about it.

There is still a widespread belief that adultery no longer constitutes marital misconduct these days: "But that's wrong," reports lawyer Maria Christina Kolar-Syrmas from practice: "Paragraph 49 of the Marriage Act explicitly lists adultery as serious marital misconduct. However, like all other marital misconduct, it must have been causal for the irreparable breakdown of the marriage."
