Pre-trial detention: who has to go behind bars and who doesn’t?

It's a recurring question: why are some suspected offenders in prison before their trial and others not? The "Krone" spoke to lawyer Sascha Flatz about the reasons for pre-trial detention, special features for juveniles and possible compensation for imprisonment. 

In Austria, there are three reasons why a detention and legal protection judge can impose pre-trial detention: Risk of absconding, risk of conspiracy and concealment and risk of repetition. If one of these applies, the accused is usually sent to a detention center of the competent regional court - however, there must always be an urgent suspicion of the crime.
