Daniela Kammerer (19) was killed in 2005 with two forceful knife stabs in a phone booth in Innsbruck. The suspect: a former college classmate (42) of the young woman from Lower Austria. As previously reported in detail, he was acquitted last week at the Innsbruck Regional Court. As of today, Tuesday, it is official: The verdict is final!

The trial took place over two days in the jury courtroom. Ultimately, the jury decided on his guilt or innocence—and they were unanimous: They unanimously acquitted the 42-year-old, who had consistently maintained his innocence and built a life for himself in Australia over the years. It took them only about an hour and a half to deliberate.

However, the verdict was not yet final. This is because the prosecution had the option to file an appeal within three days. The prosecutor made no statement at the end of the trial. It was therefore necessary to wait until the deadline passed.

Defense Attorney Speaks Out
Mathias Kapferer, defense attorney for the 42-year-old defendant, has now informed the “Krone” that the prosecution will “take no further action.” “This means that the verdict is final,” Kapferer emphasized.

Hansjörg Mayr, spokesperson for the Innsbruck District Attorney’s Office, also confirmed this in an interview with the “Krone”: “It is correct that, in this case, the District Attorney’s Office will not be filing any further appeals.”
