Construction cartel fights for general settlement

The Federal Competition Authority (BWB) has uncovered price fixing among domestic construction companies. The companies were fined a total of 183.2 million euros. As a result, injured clients (e.g. federal government, municipalities) are entitled to compensation. The construction industry is now fighting for a general settlement with a one-off payment in order to avoid an avalanche of lawsuits.

It all started with a red folder that was seized by tax investigators from a Carinthian construction company in mid-2016. It contained specific records of price agreements within the industry. The BWB then initiated investigations and carried out numerous house searches from 2017 onwards.
