Protection clause 2024 on retirement

The Styrian Chamber of Labor is receiving an increasing number of complaints regarding the amount of the increase when calculating the corridor pension. Florian Moser, an expert in social insurance law, has some valuable tips on this.

The legislator has introduced a so-called protection clause for people retiring in 2024. This was a necessary step to protect new pensioners from pension losses due to high inflation.

As of 2024, this new regulation covers the old-age pension, long-term insurance pension, heavy work pension, disability, occupational disability or incapacity pension and, under certain conditions, the corridor pension.

AK Steiermark is now receiving an increasing number of complaints that this increase amount was not taken into account when calculating the corridor pension despite previous receipt of unemployment benefit or unemployment assistance. In some cases, this could be corrected by consulting the AMS or the PVA and a significantly higher pension could be obtained.

Be sure to enquire in good time

It is therefore advisable for pensioners to enquire with the PVA after receiving their pension assessment whether the protection clause has actually been taken into account. If this is not the case, you should contact the experts at the AK Social Insurance Department immediately.
