Employee illegally transferred, nothing happens
Six years of litigation, then finally a verdict - but a city employee is still sidelined after an unjustified transfer.
For years, a city employee worked for a municipal authority. Then came the sudden transfer in 2016. Without warning, without any real justification, but with various disadvantages, including financial ones.
The Viennese woman refused to put up with this and went to the administrative court. This was in 2016, where it was established that no disciplinary measures had been taken at any time and that her last employee appraisal was "very good".
Long wait for the verdict
Three hearings had to be canceled for various reasons. It was not until 2020 that the administrative court ruled in her favor and the city filed an appeal. It then took until April 2022 for the Administrative Court to rule in favor of the employee. But nothing has happened since then. "I find it shocking that nothing happens even after this ruling," she says.
This case with such a long duration of proceedings is of course an exception. What is terrible is that nothing has happened since the ruling.

No consequences
In response to an inquiry from Krone, the city confirmed the ruling and said that there was no vacant post in her old MA. The employee is now considering further legal steps.J
