Trial in Graz
Chicken fattening scandal: diversion for two farmers
Two Styrian farmers stood trial in Graz on Monday for animal cruelty. It was about some chickens that were run over by a tractor and then left lying around. Videos from the Association Against Animal Factories had made the incident public and led to investigations. The defendants have now got off with a diversion.
In August 2022, a 55-year-old farmer allegedly ran over five chickens with a telehandler. Two or three were still alive afterwards, but were simply left lying around. The father (83) and barn owner allegedly looked on, but made no attempt to slaughter the animals, as required by law in such a case.
First trial in March
The son partially confessed at the first trial in March, but stated that he had not seen the chickens. The family had suffered great damage as a result of this incident, as the AMA seal of approval was withdrawn from the farm. The defense lawyer admitted that the pictures "look terrible", but nevertheless the whole thing was an accident.
Expert opinion was obtained
As the 83-year-old gave the impression during the first hearing that he was not always able to follow what was happening, Judge Martin Heissenberger had an expert opinion obtained. However, psychiatrist Manfred Walzl certified that the accused was able to follow the proceedings. The 83-year-old had stated that he had walked through the barn and had not noticed that at least two chickens were still alive.
"I have the impression that you are sorry," the judge credited the two farmers. He offered them diversion, which they accepted after a brief consultation with the defense lawyer. The father must pay a fine and expert costs amounting to 3723 euros. The total amount for the son is 2700 euros. If the money is not paid by the end of October, the trial will continue.
