Dispute with Vienna General Hospital
Victim of botched operation now hopes for compensation for pain and suffering
A series of botched operations has left a young woman half blind. Following the "Krone" report on this, the General Hospital relented, but has problems with its own documentation of the case.
Lisa Rainer, who lives in Styria, had to endure a series of botched operations at Vienna General Hospital. Since then, she has been unable to move her left eye, she has also seen double vision in the meantime and her field of vision will remain restricted forever. Contact attempts via her lawyer Michael Stummvoll initially went unanswered by the General Hospital for months. It was only after the "Krone" report that things started to move.
Patient files have disappeared
The hospital, or rather the hospital's liability insurance company, relented. Stummvoll obtained an agreement on an independent expert opinion from the University Hospital Jena in Germany. But there is a problem: in the course of the assessment, the hospital admits that documents are missing and the patient's surgical history can therefore not be presented.

Lisa Rainer demands compensation for pain and suffering from the AKH. This would barely cover the costs of her follow-up treatment.
"The embarrassment that the AKH is unable to provide a complete medical history reflects profound deficiencies in the documentation practices of this hospital. It is therefore questionable, as complete medical records are essential for ensuring patient safety and the quality of care," explains the lawyer. Nevertheless, the result of the medical report is expected to arrive in the next few weeks.
If the report confirms the omissions, the liability insurance of Vienna General Hospital will initially cover Rainer's personal damages. According to the AKH: "The medical documentation was sent in two tranches, first the documents available in paper form and then the electronic findings. The documents are forwarded to the expert by the liability insurance company. We regret that there have been delays here."
