Boy ordered to distribute child porn at school

The accused 14-year-old did not really want to warm to diversion at first.

A teenager sent pornographic material to an eleven-year-old and forced him to distribute it in his class. On Wednesday, the 14-year-old had to answer to the judge in Feldkirch. 

Both the accused and the victim came to the trial on Tuesday accompanied by their parents. The eleven-year-old out of fear of his tormentor. The 14-year-old because he has committed a crime and is now being held accountable in court for the first time.

A year in prison would be possible
This is a case of dangerous threats. A crime for which the law provides for a prison sentence of up to one year. In February, the older pupil sent the younger one a USB stick and a pornographic video and asked him to send the recordings to his classmates. The defendant's clear message to the first-grader: "If you don't do this, ten fourth-graders will beat you up."

To prevent the boy from telling the story at home, the 14-year-old adds verbally: "You won't have any more fun, you'll have suicidal thoughts!" Fortunately, it didn't come to that, because the boy confided in his parents. They press charges.

Lax handshake when apologizing
However, when questioned by the police, the boy denied the allegations. Things were different at the trial. However, only after the public prosecutor, judge and defense explain to the accused the advantages of a diversion and the associated criminal integrity at length.

Whereupon the 14-year-old apologizes to the victim with a limp handshake, but doesn't even look at her. Perhaps also because the accused has to do 30 hours of community service within six months as punishment. To put it in the words of public prosecutor Richard Gschwenter: "Where criminal law begins, the fun ends."
