Trial in Innsbruck
14-year-old girl raped: Syrian jailed for four years
The victim and perpetrator already knew each other, she went along voluntarily, but that is of course no license for assaults of all kinds. A Syrian man has now come to realize this at the Innsbruck regional court.
On October 14, a Syrian girl (14) allegedly went to the Innsbruck apartment of a 23-year-old from her home country. What happened next was not at all to her liking. The man allegedly used physical violence to force her to have sex five times and threatened to kill her if she told others.
Public verdict
The trial on Monday took place in camera, but verdicts and the reasons for them are still public in these cases. Accordingly, the panel of lay judges under Judge Thomas Wallnöfer agreed that the accused should be found guilty.
The concept of violence encompasses everything that attempts to overcome the physical strength and resistance of the other person.
Richter Thomas Wallnöfer in der Urteilsbegründung
The young man was sentenced to four years unconditional imprisonment and must pay 5,000 euros to his victim. The fact that the girl was not actually injured should be viewed positively, "but the concept of violence encompasses everything that attempts to overcome the physical strength and resistance of the other person", argued Wallnöfer. The defense filed a "full appeal".
