Early National Council election bureaucratically impossible

There has been repeated speculation that the regular National Council elections at the end of September could be brought forward to June 9, the day of the EU elections. This is no longer possible. A corresponding time window has closed.

A new election petition from the National Council would first be necessary to bring forward the date. After the corresponding resolution, which can also be passed in a special session, it must be assigned to the Constitutional Committee and dealt with there. It then goes back to the plenary.

Time too short for the entire procedure
The following legal deadline then applies for setting the election date: according to the National Council election regulations, there must be 82 days between the deadline to be set with the announcement of the election, from which various deadlines begin to run, and the election, which would be March 19 for a ballot on June 9. In addition, the election must be advertised in the Federal Law Gazette at least one day beforehand. BUT: The time is now too short for the procedure up to the announcement of the election day in the Federal Law Gazette at least one day before.

The ordinance then goes to the main committee, which has to confirm the date with a parliamentary majority. Finally, a request is made to the Federal President to make the election public by announcing it in the Federal Law Gazette. Depending on the National Council and government meetings and the approval of the Federal President, the process can therefore take at least one, if not several weeks.

Bureaucratic procedures
Various deadlines begin to run from the cut-off date, such as those for appointing the district electoral officers, the assessors and for constituting the electoral authorities. It also determines various requirements for the right to vote, eligibility for election and the collection of declarations of support from smaller parties. The upper limit on election campaign costs also begins to apply from this day.
