Colonoscopy case: investigation closed again

The expert back and forth in the case of the woman from Lungau (66) who died in January 2023 after a colonoscopy at Tamsweg Hospital (Salzburg) has come to an end: The public prosecutor's office has once again dropped the investigation against two doctors on suspicion of negligent homicide.

After two expert reports on the case came to completely contradictory conclusions, the judiciary reopened the investigation, which had actually been discontinued in the fall of 2024, and commissioned a third so-called top expert report.

This has now been received by the court and exonerated the two doctors. In detail, no misconduct could be proven against the doctors in the treatment of the 66-year-old woman. In medical jargon, they are said to have performed the gastroscopy and colonoscopy "lege artis".

Written justification is requested
The relatives' lawyer, Stefan Rieder, still wants to review the second dismissal: "I will request a written statement of reasons." Rieder is also considering submitting a further application for reinstatement.
